Welcome to the rehabmeasures.org web site (“Web Site”).  All uses of the Web Site are subject to the following Terms and Conditions of Use.

 

Please read these Terms and Conditions of Use carefully before accessing or using any part of this Web Site. By accessing or using the Web Site, you agree that you have read, understand and agree to be bound by these Terms and Conditions of Use, as amended from time to time, as well as the RIC Privacy Policy, which is hereby incorporated into these Terms and Conditions of Use. If you do not wish to agree to these Terms and Conditions of Use, do not access or use any part of the Web Site.

 

RIC may revise and update these Terms and Conditions of Use at any time by posting the amended terms to the Web Site. Your continued use of the Web Site means that you accept and agree to the revised Terms and Conditions of Use. If you disagree with the Terms and Conditions of Use (as amended from time to time) or are dissatisfied with the Web Site, your sole and exclusive remedy is to discontinue using the Web Site.

 

COPYRIGHT RESTRICTIONS/USE OF CONTENT

Unless stated otherwise, the content of the Web Site (including all information, software, text, displays, images and audio) and the design, selection and arrangement thereof, are proprietary to RIC or its licensors and are protected by United States and international laws regarding copyrights, trademarks, trade secrets and other proprietary rights. You are authorized only to use the content on the Web Site for personal use.  Neither the title nor any intellectual property rights to any information or material on theWeb Site are transferred to you, but remain with RIC or the applicable owner of such content.  You may not copy, modify, create derivative works of, publicly display, republish, store, transmit, or distribute any of the material on the Web Site for the purpose of making them available in the aggregate over the Internet, in a publication, or in other public use.  

 

The Rehabilitation Institute of Chicago (“RIC”) respects the intellectual property of others.  If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide the following information in English to rehabmeasures@ric.org, attention Jill Smiley:

 

1.      an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

2.      a description of the copyrighted work or other intellectual property that you claim has been infringed;

3.      a description of where the material that you claim is infringing is located on the Rehabmeasures site, with enough detail that we may find it on the website (in most circumstances, we will need a URL);

4.      your address, telephone number, and email address;

5.      a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;

6.      a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

 

Note: If you are asserting infringement of an intellectual property right other than copyright, please specify the intellectual property right at issue (for example, ‘trademark’).  In some circumstances, RIC may forward a copy of a valid Notice to a third party.

 

TRADEMARKS

The term “Rehabilitation Institute of Chicago” is a trademark and the Rehabilitation Institute of Chicago logo and all related product and service names, designs and slogans are RIC trademarks. You may not use RIC's name, logo or marks in any manner whatsoever, without RIC’s prior written permission. All other names, brands and marks are used for identification purposes only and may be trademarks or registered trademarks of their respective owners.

 

MEDICAL ADVICE IS NOT PROVIDED ON THIS WEB SITE

The information and content contained on or otherwise made available through the Web Site is for informational purposes only and is never intended to be a substitute for, or relied upon as, professional medical advice, diagnosis or treatment.  Always seek the advice and follow the treatment recommendations of your physician or other professional healthcare provider.

RIC shall not be responsible, in any way, to you or others arising from the use or failure to use the information provided by this Web site. RIC does not guarantee the information provided in this Web site and is not responsible for any associated errors or omissions. RIC welcomes your comments. All comments, suggestions or other information sent by you to this Web site for internal use by RIC or its advertisers or business partners or in response to solicitations on this Web site, will become RIC’s property, and you agree that all intellectual property rights therein are transferred to RIC. The information you provide may be monitored to ensure the appropriate use of the Web Site or otherwise viewed in the course of system maintenance by RIC or its agents. You acknowledge and understand that individuals that perform these functions may have access to any information you disclose to RIC.

 

In the event that you send health information to RIC, you are authorizing RIC to provide such information to the appropriate provider for the sole purpose of obtaining an appointment with an RIC affiliated provider.

 

You acknowledge that you are responsible for all information you send to the Web site. No Web site user may post or transmit any information that is illegal, threatening, libelous, defamatory, obscene, ethnically or racially offensive or discriminatory, profane, invades the privacy of another person or any other information or materials that constitute a crime, give rise to a civil action or otherwise violate any law or confidentiality agreement. ADVERTISING

Advertising allows RIC to provide free access to evidence-based information through the Rehabilitation Measures Database (RMD) regarding outcome measures used by clinicians and investigators.  The advertisements on the rehabmeasures.org website are labeled “advertisement.”  Advertising content on the RMD website is provided by Google AdWords and reasonable efforts have been made to ensure that no advertisement makes an unsubstantiated health claim.  RIC reserves the right to refuse advertisements that are incompatible with its mission and encourages users of the site to report ads that they believe may be incompatible with the purpose of the information provided in the RMD website.  RIC does not explicitly or implicitly endorse or recommend third parties, or their products, or services, who advertise on the site.  Advertising does not influence RIC’s editorial content on its sites.

 

RIC shall not be responsible for any loss or damage of any kind incurred as a result of the presence of such advertisements on its sites.  RIC shall not be responsible or liable for the statements or conduct of any third party advertisers appearing on its sites.  You shall be solely responsible for any correspondence or transactions you have with any third party advertisers.  RIC’s sites may provide links (including any link through an on-line banner advertisement) to other sites on the Internet for your convenience. These other sites are maintained by third parties over whom RIC exercises no control. The appearance of any such third party links is not intended to endorse any particular company or product. The owner of this Web site is based in the State of Illinois, USA. RIC makes no representation that materials in this Web site are appropriate or available for use in other locations. If you access this Web site from other locations, you are responsible for complying with local laws.

 

You consent and submit to the personal jurisdiction of the State of Illinois and venue of the County of Cook for any state or federal action arising out of the use of this Web site or this Disclaimer Agreement. Neither the use of the Web site nor this Disclaimer Agreement constitute doing business in any other state than the State of Illinois.

 

These Terms and Conditions of Use, as amended from time to time, completely and exclusively state the agreement between you and RIC with respect to the RIC Web Site, and no other terms that may have been communicated to you orally or in any other manner shall have any force or effect. Any cause of action you may have with respect to the RIC Web Site must be commenced within one (1) year after the claim or cause of action arises.

 

If any part of these Terms and Conditions of Use is unenforceable, the unenforceable part shall be construed to reflect, as nearly as possible, the original intentions of the parties. The other provisions of these Terms and Conditions of Use shall remain in full force and effect.

 

RIC’s failure to insist upon or enforce strict performance of any provision of these Terms and Conditions of Use shall not constitute a waiver of the provision. Neither a course of dealing or conduct between you and RIC nor any trade practices shall be deemed to modify these Terms and Conditions of Use.
